Where registrants facing discipline represent themselves in hearings, they generally have the right to cross-examine all of the regulators’ witnesses. Where the regulators’ witnesses include the complainant or other vulnerable witnesses, it is often preferable for all participants to have legal counsel appointed to cross-examine such witnesses on behalf of the registrant. Though we would not be the registrant’s legal counsel in these circumstances, we can assist both the regulator and the registrant by serving in this capacity, often referred to as amicus curiae, or a “friend of the court (tribunal)”.
